This Privacy Policy explains how Bayshore Integrated Health PA and its affiliated entities (collectively, the “Company,” “we” or “us”) collect and use Personal Information. It applies to our websites or other services that directly link to this Privacy Policy (collectively, “Sites”). Please see our HIPAA Notice of Privacy Practices which governs, as applicable, how we use and disclose protected health information. This notice does not apply to our employees or contractors.

Categories of Personal Information

Personal Information includes any information that may be used to identify an individual. Please review our HIPAA Notice of Privacy Practices for information on the protected health information that we collect. We collect the following categories of Personal Information:

• Contact Information: your first and last name, email address, a home, postal or other physical address, and phone number
• Other identifying Information: your IP address, user names, passwords, and other security information for authentication and access
• Demographic Information: age, gender, occupation, industry, personal interests, education information, and salary information
• Location Information: your rough geo-location based upon your device's IP address
• Log Data: your device identifier, user settings, browser type, operating system, the web page that you were visiting before accessing our Sites, the pages or features of our Sites to which you browsed to give us an idea of which part of our Sites you visit and how long you spend there
• Audio/Visual Data: audio, electronic, photographic, visual or similar data including videos, photographs, or audio recordings
• Employment and Education Information: Employment and education history and license information

Purposes for Collecting Personal Information

Information on how we use your protected health information can be found in the HIPAA Notice of Privacy Practices. We use your Personal Information for the following categories of use:

• Transactional Purposes: We use your contact information, other identifying information, and employment and education information to:
  • To provide you with and manage your access to the Sites
  • Communicate with you about the Sites
  • To process your application for employment
• Analytical Purposes: We use your other identifying information, log data, demographic information, and location information to analyze preferences, trends and statistics.
• Recruiting and Hiring: We use contact information, other identifying information, and employment and educational information to make informed decisions on recruitment and assess your suitability for the role, communicate with you about your application, respond to your inquiries and schedule interviews, and to reimburse you for any agreed expenses incurred in the application process.
• Marketing and Promotional Purposes: We use your contact information, other identifying information, demographic information, location information, employment and education information, and log data to:
  • Inform you of our new products, services and offers; and
  • Provide you with other information from and about our Company, including personalized marketing communications.
• Maintenance and Improvement of the Sites: We use other identifying information and log data to administer the Sites and we analyze (and may engage third parties to analyze) other identifying information, log data, demographic information, and location information to improve, customize and enhance the Sites by expanding their features and functionality and tailoring them to our users' needs and preferences.
• Security and Fraud Prevention: We use your contact information, other identifying information, location information, and log data to protect the Sites, our Company, and others and to prevent fraud, theft, and misconduct.
• Legal: We use contact information, other identifying information, demographic information, location information, log data, and employment and education information to comply with our legal obligations, including reporting requirements, and defend ourselves in legal proceedings, and protect our company and our property, employees, and others through legal proceedings.
• Other Purposes: We use contact information, other identifying information, demographic information, location information, log data, and employment and education information for other reasons we may describe to you.

Sources of Personal Information

We collect, and in the preceding 12 months have collected, Personal Information from the following sources:

• Directly from you. We collect contact, other identifying information, and demographic information directly from you. This includes when you register for an account or when you submit your Personal Information to us on the Sites.
• From third parties. We collect your contact information, other identifying information, demographic information, log data, location information, and employment and education information from third parties, including our vendors, clients, recruiters, and service providers. We may collect your Personal Information from social media sites, in accordance with their terms of use and privacy policy.
• From our job applicants. We collect contact information, identifiers, employment and education information from our job applicants.
• We collect information from you automatically. We collect other identifying information and log data passively from your device and through using tools like browser cookies. This activity is further described in the Cookies section below. You understand that, by logging into the app on your mobile device, some information pertaining to your medical treatment may be stored to your mobile device. We are not responsible for any unauthorized access by any third party to such information on your mobile device.
• Social media platforms. Depending on the information you choose to share and your privacy settings, we may collect contact information, identifiers, audio/visual data, geolocation data, employment and education information, and log data. Based on the way you have set your privacy settings on your social media accounts, most social media platforms analyze data about how you interact with our Sites and combine it with information on other users to provide us information about you. In addition, we may receive information about you if other users interact with us on social media and information about you is visible to us.

Disclosures of Personal Information

Information on how we disclose your protected health information can be found in the HIPAA Notice of Privacy Practices. We disclose Personal Information to third parties in the following circumstances:

• Service Providers. We may engage third-party service providers to work with us to administer and provide the Service. These third-party service providers have access to your Personal Information only for the purpose of performing services on our behalf and are expressly obligated not to disclose or use your Personal Information for any other purpose. In the past 12 months, we have disclosed contact information, other identifying information, log data, demographic data, location data, audio/visual data, and employment and educational information to our service providers.
• Affiliates. We may disclose Personal Information with businesses controlling, controlled by, or under common control with our Company. In the past 12 months, we have disclosed contact information, other identifying information, log data, demographic data, location data, audio/visual data, and employment and educational information to our affiliates.
• Analytics and Advertising Partners. We may share personal information with third party analytics or advertising partners, who provide analytics, marketing, and advertising services to us. In the past 12 months, we have disclosed other identifying information, log data, demographic data, and location data to our analytics and advertising partners.
• In Connection with Business Transactions. Information that we collect from our users, including Personal Information, is considered to be a business asset. Thus, if we are acquired by a third party as a result of a transaction such as a merger, acquisition or asset sale or if our assets are acquired by a third party in the event we go out of business or enter bankruptcy, some or all of our assets, including your Personal Information, may be disclosed or transferred to a third party acquirer in connection with the transaction.
• For Our Protection and the Protection of Others. We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate: (i) to enforce our Terms of Use, (ii) to respond to claims, legal process (including subpoenas); (iii) to protect our property, rights and safety and the property, rights and safety of a third party, our users, or the public in general; (iv) to stop any activity that we consider illegal, unethical or legally actionable activity; and (v) as required in accordance with HIPAA or related applicable local, state or federal laws.
• Other Reasons. We may disclose personal information for other reasons we may describe to you if you consent to the disclosure or direct us to disclose your information.

We Combine Information

We combine information we obtain from different sources with publicly available information, including to create inferences about you. For example, we may combine information that we have collected offline with information we collect online. We combine information that we have collected across other third party sites. We combine information across devices, such as computers and mobile devices. We may also combine information we get from a third party with information we already have.

How Long We Keep Personal Information

We will retain and use your information for as long as we need it to provide you services, or as long as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Where we process personal information for marketing purposes, we process the data until you ask us to stop and for a short period after this (to allow us to implement your requests). We also keep a record of the fact that you have asked us not to send you direct marketing so that we can respect your request in future. We use the following criteria to determine retention periods:

• how long the information is needed to provide our services and operate our business;
• whether there are contractual or legal obligations that exist that require us to retain the information for period of time;
• whether any law, statute, or regulation allows for a specific retention period;
• whether an individual has agreed to a longer retention period;
• whether the data is considered to be sensitive data; and
• what the expectation for retention was at the time the data was provided to us.

Cookies and Tracking Technology

We want you to be aware that certain online tools exist to help us serve and recognize you when you visit our website. We receive and store certain types of information when you visit our website. When you access the website, we (including third-party analytics and advertising companies we work with) may place small data files on your computer or other device. These data files may be web beacons, cookies, clear gifs, pixel tags, e-tags, flash cookies, log files, or other local storage provided by your browser or associated applications. These tracking technologies, which are often referred to collectively as cookies, collect information about your use of the Sites and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked and conversion information. These service providers may use certain information (e.g. click stream information, web browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to our website and other websites in order to provide advertisements about services likely to be of interest to you. Your Choices

Opt-Out. We may periodically send you our newsletter and e-mails that directly promote our Sites. When you receive such promotional communications from us, you will have the opportunity to “opt-out” (either through your account or by following the unsubscribe instructions provided in the e-mail you receive). We do need to send you certain communications regarding the Sites and you will not be able to opt out of those communications — e.g., communications regarding updates to our Terms of Use or this Privacy Policy.

Data Security

The Company safeguards the security of the information you provide to us with physical, electronic, and managerial procedures. While we strive to protect your Personal Information, we cannot guarantee the security of the information you transmit to us, and so we urge you to take every precaution to protect your Personal Information when you are on the Internet.

Responding to Do Not Track Signals

Our website does not have the capability to respond to “Do Not Track” signals received from various web browsers.

Children and Privacy

We may collect Personal Information about children under 13 that parents or guardians provide to us when establishing an account for their children's telehealth consultations. We may also collect Personal Information from children during a telehealth consultation, including first and last name; medical information; a video or audio file containing the child's image and voice; persistent online identifiers from the devices used by children, including IP address, processor or device serial number, and unique device identifier; and geolocation information. We use this information to deliver telehealth consultations, analyze site traffic, optimize site performance, improve our Sites, and comply with our legal and regulatory obligations. To the extent allowed by applicable law, including, but not limited to, HIPAA, we may share this information with third parties to perform quality improvement activities or research and analysis. We may also share this information with service providers who help us deliver our Sites and give individuals a better user experience. Lastly, we may disclose this information in connection with business transactions; to comply with federal, state, or local laws; to comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, or summons by federal, state, or local authorities; to cooperate with law enforcement agencies concerning conduct or activity that we, our service provider, or a third party reasonably and in good faith believe may violate federal, state, or local law; or to exercise or defend legal claims.

Children under the age of 13 may only use our Sites if we have obtained verified parental consent. We do not knowingly collect information from children under the age of 13 unless verified parental consent has been received. If we learn that we have collected the information of a child under the age of 13 without receiving verified parental consent, we will delete such information from our records.

We use appropriate and reasonable security measures as required by relevant law to maintain the confidentiality, security, and integrity of children's personal information. We will retain children's information only for as long as is necessary to fulfill the purpose for which it was collected and subsequently delete the information using reasonable measures.

Parents and guardians of children under the age of 13 may request to review their child's personal information, request that we delete it, and refuse to allow any further collection or use of their child's information. Third Party Sites

The Sites contain links to other sites that are owned or operated by third parties. We are not responsible for the content, privacy or security practices of any third parties. To protect your information, we encourage you to learn about the privacy policies of those third parties.

International Transfer

Your information is stored by the Company on controlled servers with limited access and may be stored and processed in the United States or any other country where the Company or agents are located. If you're located outside the United States and choose to provide your Personal Information to us, we may transfer your Personal Information to the United States and process it there. Those who choose to access and use the Sites from outside the U.S. do so on their own initiative, at their own risk, and are responsible for compliance with applicable laws.

California Consumer Privacy Rights

California residents have certain privacy rights under the California Consumer Privacy Act, as applicable. This section describes those rights and how you can exercise them with our Company. You must use “CCPA Rights Request” in the subject line of your email. You must provide us with your first name, last name, email address, and phone number. To verify your identity, we will match that information to the information we have on our systems. Sale or Sharing of Personal Information. In the preceding 12 months, we have “sold” or “shared” (as those terms are defined in the CCPA) other contact information, identifying information, demographic, log data, and location data to analytics/advertising partners. We do not knowingly sell or share the personal information of minors under the age of 16.

Your Rights Under the CCPA. Subject to certain exceptions and limitations, the CCPA affords California consumers the following rights:

• You have the right to request that we tell you (i) what personal information we have collected about you, (ii) the sources of that information, (iii) the business or commercial purposes for collecting, selling or sharing the personal information; and (iv) the categories of third-parties to whom we have disclosed personal information.
• You have the right to request that we provide you with a copy of your personal information.
• You have the right to request that we delete personal information that we have collected from you. We may not delete all of your personal information if one of the exceptions to the CCPA applies.
• You have the right to opt-out of the sale of your personal information or sharing of your personal information for cross-contextual behavioral advertising.
• You have the right to correct inaccurate personal information that we hold about you.
• You have the right to not be discriminated against for exercising any of your CCPA rights. We will not discriminate against you, deny you services, charge you a different price, or provide you with a lesser quality of services if you exercise any of your CCPA rights.

We may amend this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we will notify you of those changes by posting on the Sites and we will update the “last updated date” above to indicate when those changes became effective.
